cate@ms-solicitors.co.uk Tenancy Breach Hello, My name is Michael John Burdette-Deaking (aka MJDeakin), thankyou in advance for the time taken to read this email. I am currently residing at 175 Station Road, Burgess Hill, West Sussex. I am currently in reciept of housing benefit and income support based DLA. I understnad that my case may not yet be at a 'critical' stage but I would like to solicit some sound advice to be sure of my ground if my 'case' falls withing your scope. I am currently keeping a number of exotic birds, I started with one... a yellow backed chattering lory(Houdini), my housing manager (Caroline Pumford, Chichester Diocesan Housing Association) was aware of this initial 'aquirement' and was prepared to 'turn a blind eye'. I am led to believe she keeps birds herself but I this is probably 'hearsay'. After the forced closure of the local exoctics shop I was offered several more birds and my 'flock' has increased to nine... yes nine, however, although nine does sound an awful lot of birds to keep in one small one bedroom flat, six of those birds are no bigger than your thumb and live in a self-contained mini environment specially constructed for them. Alongside my lory I also have two Eastern Australian Rosella's (small parakeet), these three birds live freely in the living room. Sounds messy right? Wrong... the Lory has his own 'area' with his 'mess tray' being the roof of the 'finch world'. the two rosella's fly back and forth between to specially constructed 'mess trays' high in two corners of the room and sometimes (when they can get away with it) will play on the Lory's 'stuff'), no 'mess' ever reaches the floor. I was recently in the local newspaper with an article concerning an incident with a staff member at Waitrose in the Martletts shopping mall in Burgess Hill, as result of news of this 'incident' our local 'goody, goody' neighbours have reported me to the housing association for keepin "Nine birds loose in the flat making noise and mess everywhere... etc". I have since been paid a visit by Caroline Pumford my housing manager and an accomplice and was told that I was in breach of tenancy and she would have to seek legal advice. I assured her I would be prepared to get rid of the pair of rosella's as they are properly an aviary bird and I don't really feel the space I afford them is adequate for them. This was four days ago. I have tentatively agreed also to reduce the number of finches to four, possibily two... but this will be a very reluctant decision and in view of the current bird-flu crisis threatening the UK I have serious doubts I would be able to find homes for any of the birds. Currently they are 'safe' even if avian-flu does strike here. They are inside and only the Lory goes out and that more infrequently as the weather closes in for winter. I have a website with a Biography section, in there is a photo album with several photo's of the birds (and my own) living conditions.
